Mismoosh Ltd – Terms & Conditions

1. Definitions & Overview
These Terms and Conditions apply to all services and products offered by Mismoosh Ltd, a UK-based business providing:
- Online and in-store sales of toys, outdoor gear, and IT products
- IT repair, advice, and data recovery
- Legal and court support for individuals and organisations
- Outdoor guidance, hiking, and survival instruction
Mismoosh Ltd operates across the United Kingdom, European Union, United States, China, and Taiwan.
2. Eligibility & Capacity to Contract
You must be 18 years or older to enter into a contract with Mismoosh Ltd.
Some products and services we offer (e.g. outdoor equipment, IT items, tools, or knives) are age-restricted by law. We comply with all applicable restrictions in the UK, EU, and USA, including:
- UK: Alcohol, tobacco/vapes, knives, fireworks, solvents (18+); aerosol paint (16+); crackers (12+); and media (BBFC: 12, 15, 18)
- EU: Most member states restrict alcohol, tobacco, weapons, and fireworks to age 18+. Media is subject to PEGI and national classifications.
- USA: Alcohol (21+), tobacco and knives (18+), firearms (varies), and ESRB/MPAA ratings apply for media
We may request proof of age where necessary and reserve the right to cancel or refuse orders that violate relevant laws.
Exception – Legal Support: In urgent or safeguarding situations, a minor (under 18) may request legal assistance independently if their parent or guardian is unavailable or unwilling to assist. This is considered on a case-by-case basis under UK and EU legal principles.
3. Orders, Payments & Pricing
We comply with the UK Consumer Rights Act 2015, which guarantees that goods must be:
- Of satisfactory quality
- Fit for purpose
- As described
Services are delivered with reasonable care and skill.
If your statutory consumer rights differ based on your location (e.g. EU-based), we aim to honour applicable consumer laws to the extent required by cross-border regulations.
- Prices are clearly displayed before checkout.
- Payment options include Stripe, PayPal, Squareup, Monzo, NatWest, cash, Google Pay, iPhone, and iDEAL.
- Third-party processors operate under their own data and payment rules.
- Payment is due at the time of booking or order, unless otherwise agreed.
4. IT Services & Data Recovery
- You are responsible for backing up your data before handing in devices.
- If passwords or login access are needed, we require consent to proceed.
- Data recovery is not guaranteed. Clients are still required to pay for diagnostics and all attempted recovery work, even if full or partial recovery fails.
- If an item is submitted for repair and cannot be fixed, a basic inspection fee or minimum service charge still applies. This covers diagnostic time, part assessment, and communication.
- Recovered or repaired devices will be returned via USB, cloud link, or secure handover.
5. Legal Support Services
- Legal support includes case file preparation, evidence sorting, secure submissions, and administrative help.
- After an initial consultation (free of charge), we assist with file reading, court preparation, document review, and communication with professionals.
- We support clients in the UK, Belgium, and the Netherlands, as well as certain EU legal matters under Brussels I and II regulations.
- While we are not a translation agency, we can connect clients with certified legal translators when required (additional costs may apply).
- We support Litigants in Person (LIP) by providing assistance and guidance, but we do not act as legal agents or sign court documents on a client’s behalf.
- We do not address the court or examine witnesses unless permission is explicitly granted by a judge under exceptional circumstances.
- All legal clients must agree to our Data Processing Agreement (DPA).
- We are not responsible for the outcome of any legal decision or court ruling.
- Clients from the EU may engage our services for cross-border support.
- Payments are accepted via debit/credit card, iDEAL, BACS, and other secure methods.
- We support Litigants in Person (LIP) but do not act as their legal agent. We assist and advise, but clients sign and submit their own documents.
- We cannot speak or cross-examine in court unless specifically granted permission by the judge (exceptional cases only).
- We assist clients in Belgium, Netherlands, and the UK, and also support legal preparation for EU jurisdictions (Brussels I & II).
- We are not a translation agency. Clients must submit official translations with original documents. We can connect clients with licensed translation professionals (costs apply).

- Clients from the EU may engage our services for cross-border support.
6. Outdoor Services
- Outdoor activities involve physical risk. Clients must assess their ability to participate.
- Medical or allergy information must be disclosed in advance.
- Clients agree to follow instructions and safety briefings during guided walks, hikes, or survival training.
- We may facilitate bookings through trusted third-party providers such as National Express, FlixBus, Holiday Homes, Booking.com, Airbnb, and others. These providers operate under their own Terms & Conditions, including cancellation and insurance policies, which clients must review independently.
- ATOL protection may apply only to services booked directly through licensed third-party travel operators. Mismoosh Ltd is not an ATOL holder.
- All clients are required to have valid travel insurance and to provide relevant medical details if participating in any trip, tour, or extended outdoor service.
- We act solely as an organiser or intermediary and cannot accept liability for third-party provider actions or failures.
- In the event of issues during travel or outdoor events, a representative from our company is typically present and will do everything reasonably possible to assist. Some circumstances, including serious injury or death, are beyond our control. However, we never abandon our duty of care and always aim to support clients within what is legally and financially reasonable.
- Medical or allergy information must be disclosed in advance.
- Clients agree to follow instructions and safety briefings during guided walks, hikes, or survival training.

7. Refunds, Returns & Cancellations
- We follow UK Consumer Rights and EU Distance Selling regulations for eligible returns of physical goods.
- Custom services (such as legal, IT support, and personal outdoor sessions) are exempt from refunds once service has started or significant work has begun.
- Diagnostic fees, investigations, or written advice may be non-refundable if already delivered.
- If you need to cancel a scheduled service or outdoor activity, please notify us at least 24 hours in advance. Late cancellations may not qualify for a refund.
- In certain cases, we will consider credit toward a future booking.
- Refunds for third-party bookings (travel, lodging, etc.) are subject to the third party’s own terms and refund policies.
- For services or experiences listed on Airbnb, Booking.com, or other platforms, refunds, returns, and cancellations are governed by the platform’s own terms. Clients must review those terms at the time of booking.
- If a cancellation, delay, or insurance issue arises, we aim to fully cooperate with the client and third parties to the best of our ability, based on the situation. We provide written documentation or explanations when needed and help resolve problems where we reasonably can.

8. Your Responsibilities
If a customer lacks mental capacity (e.g. due to illness or safeguarding concerns), we may require verification from a legal representative or advocate. We handle all such cases with discretion, confidentiality, and in line with UK safeguarding guidance.

9. Website Use
- The Mismoosh website and digital tools are for lawful personal or business use only.
- You may not copy, scrape, exploit, or interfere with the website’s functionality.
- Any attempt to misuse forms, tools, or automated access systems is prohibited.
- Mismoosh Ltd may change or suspend website features, pricing, or services at any time.
- Third-party tracking technologies and cookies may be used on our site. You can find details in our Privacy Policy and Cookie Notice.
10. Intellectual Property
- All materials, logos, videos, documents, and training tools produced by Mismoosh Ltd remain our property unless otherwise stated.
- This includes multimedia we create and publish on platforms like TikTok, YouTube, Meta (Facebook and Instagram), WhatsApp, eBay, and our website.
- Content co-created with clients or affiliates is also protected unless a separate licence agreement applies.
- You may not reuse, copy, distribute, or modify our resources without our written permission.
- Data protection laws also apply to client recordings or shared data appearing in our media.
11. Privacy & Data Security
We take privacy seriously. Your data is handled in line with our Privacy Policy and Data Processing Agreement (DPA).
Mismoosh Ltd collects and processes data across the UK, EU, and select international regions (USA, China, Taiwan).
We use secure third-party platforms to support our services, including:
- Meta (Facebook, Instagram, WhatsApp)
- TikTok and TikTok Shop
- YouTube
- eBay
- Stripe, PayPal, Squareup, Google Pay, iPhone, iDEAL
- Zivver (for encrypted medical/legal emails)
- Google, Meta, Amazon (for data storage and backups, including WhatsApp message and media backups)
- Plusnet, EE, Tesco Mobile (for internet and mobile access)
- Namecheap (USA) for SSL-secured website hosting
Please note that some data—such as WhatsApp messages, phone contact logs, or media files—may also be stored or processed by third-party providers outside our direct control. These providers operate under their own privacy and data policies.
We apply strong protections including encryption, verified access, regular backups, and secure payment gateways.

12. Liability & Limits
Mismoosh Ltd takes reasonable care in providing services and selling goods, but we cannot guarantee outcomes beyond our control.
- We are not liable for indirect loss, consequential damages, missed opportunities, data corruption, or legal decisions made by courts or authorities.
- Our liability is limited to the amount paid for the relevant service or item.
- For IT and data recovery, we cannot guarantee success, and clients accept that partial or full loss may still occur despite best efforts.
- For legal and advocacy services, we offer administrative and procedural support. We are not responsible for the final outcome of any case, tribunal, or ruling.
- For outdoor and travel-related services, Mismoosh Ltd does not accept responsibility for weather conditions, third-party transport disruptions, illness, injury, or force majeure events.
- Clients participate at their own risk and must hold valid insurance where applicable.
We always aim to act professionally and cooperatively. However, we cannot be held liable for losses caused by:
- Misuse of our services
- Failure to provide essential information
- Changes in law, policy, or third-party platforms beyond our control
13. Legal Jurisdiction
We comply with the Alternative Dispute Resolution (ADR) for Consumer Disputes (Competent Authorities and Information) Regulations 2015.
You may access the European Commission’s ODR (Online Dispute Resolution) platform at: https://ec.europa.eu/consumers/odr.
These Terms and all services provided by Mismoosh Ltd are governed by the laws of England and Wales.
Clients based in the European Union may raise issues in accordance with EU Consumer Regulations and cross-border commerce rules, where applicable.
In the event of a dispute, both parties agree to first attempt resolution via direct negotiation or alternative dispute resolution (ADR). If unresolved, legal action may be brought in the courts of England and Wales, unless otherwise required by mandatory local consumer protection laws.
Mismoosh Ltd fully cooperates with recognised legal authorities in the UK and EU and encourages good-faith efforts to resolve concerns promptly.
